COMPLETE AGREEMENT TERMSScroll to read

01. Parties & booking confirmation

This agreement is between the client identified in the submitted event details (“Client”) and TAVE (“Artist”), the independent saxophone performer. An inquiry or submitted form does not reserve a date. The booking is confirmed only after Artist reviews and accepts the terms in writing and receives the agreed booking retainer.

02. Performance services

Artist will provide live saxophone music for the agreed event, date, location and time. Standard setup and breakdown and appropriate sound equipment are included only as specified in the accepted written quote. Song requests and extra services require advance written agreement.

03. Fee, retainer & remaining balance

The fee is the amount in Artist’s accepted written quote, not an amount selected by the Client on this website. Unless otherwise agreed in writing, a 50% booking retainer is due to reserve the date and the remainder is due seven calendar days before the event. No payment is collected on this website. Artist will communicate payment instructions separately.

04. Client cancellation

Client must give cancellation notice in writing. A booking retainer may be retained only to the extent it represents legally enforceable compensation for reserving the date and reasonable lost opportunities or preparation. Amounts beyond enforceable retention or recoverable damages for undelivered services will be refunded; no unlawful penalty or double recovery is intended.

05. Rescheduling & changes

Changes to the date, duration, location or service scope require mutual written acceptance and are subject to Artist availability. Changes may require a revised quote. If the parties cannot agree on a new date and the Client will not proceed on the original date, the cancellation terms apply.

06. Venue, weather & safety

Client will arrange venue access, a stable safe playing area, and appropriate electrical power when needed. For outdoor events, Client must provide reasonable protection from rain, unsafe weather and equipment hazards. Artist may pause or decline an unsafe performance; the parties will first consider a safe alternative and handle undelivered services in accordance with the circumstances and applicable law.

07. Timing, delays & overtime

The agreed start and end times define the contracted performance window. Client-caused delay does not automatically extend the end time. Overtime or major schedule changes require Artist approval and an agreed additional fee before additional work begins.

08. Artist cancellation & emergencies

If Artist must cancel for a reason other than a qualifying extraordinary event or material Client breach, Artist will give prompt notice and refund amounts received for services not performed within 14 calendar days. A substitute performer will not be used without Client approval. The parties will discuss rescheduling when circumstances beyond their reasonable control prevent safe performance.

09. Conduct, equipment & recordings

The parties will act professionally. Client will make reasonable efforts to protect equipment and the performance space from interference. Personal photos and short videos that do not interfere with performance are permitted; commercial use, livestreaming, or broadcast require separate permission and any necessary third-party rights. Promotional use of identifiable private-event footage requires appropriate permissions.

10. General terms & electronic acceptance

Artist is an independent contractor. Texas law governs subject to mandatory applicable law. The accepted written quote, these standard terms and any written amendments together form the parties’ agreement after Artist’s written acceptance. A typed legal name and express electronic-signature consent indicate the Client’s intent to sign. Artist will retain a record of the submission; clients should save their PDF copy.
